Agreement to Terms

Start a Business in Africa operates as a digital platform providing market intelligence and facilitating cross-border corporate services, including company formation, tax registration, and investment licensing across multiple African jurisdictions.

The information provided on our public country guides is for general informational purposes only and does not constitute formal legal or tax advice. A formal attorney-client or advisor-client relationship is only established once a specific Letter of Engagement has been signed and the requisite compliance onboarding is completed.

Key Conditions of Service

Understanding the boundaries of our advisory services and your responsibilities as a client.

Accuracy of Information

You agree to provide true, accurate, and complete information during the onboarding and incorporation processes. Falsifying identities, beneficial ownership, or source of funds will result in the immediate termination of services without refund and potential reporting to relevant authorities.

Government & Registry Delays

While we provide estimated turnaround times (e.g., “3 to 5 days”), we do not control government registries, ministries, or central banks. We are not liable for delays caused by government system outages, bureaucratic backlogs, or regulatory audits.

Intellectual Property

All content on this website including country guides, business tips, graphics, and proprietary methodologies is the intellectual property of Start a Business in Africa. You may not scrape, reproduce, or commercially distribute this content without our express written permission.

Engagement & Liability

01

Mandatory KYC / AML Compliance

Before we commence any company formation or advisory work, you must pass our Know Your Customer (KYC) protocols. We reserve the right to refuse service to any individual or entity failing to meet international Anti-Money Laundering (AML) standards.

02

Fees and Disbursements

Our invoices clearly separate our professional service fees from government disbursements (taxes, registry fees, notary costs). Professional fees are generally required upfront. Government fees are strictly non-refundable once paid to the relevant authorities.

03

Cancellation & Refunds

If you cancel an engagement before documents have been drafted or submitted, a partial refund may be issued minus administrative costs. No refunds will be provided once work has commenced or documents have been filed with a jurisdiction’s registry.

04

Limitation of Liability

To the maximum extent permitted by law, Start a Business in Africa shall not be liable for any indirect, incidental, or consequential damages (including lost profits or business interruption) arising from the use of our services. Total liability is strictly capped at the amount of professional fees paid by the client.

Governing Law & Dispute Resolution

Because we operate across dozens of sovereign nations, navigating disputes requires a standardized framework.

These Terms of Service, and any disputes arising directly from the use of this website or our central advisory services, shall be governed by and construed in accordance with international commercial law. Any irreconcilable disputes shall be resolved through binding arbitration, rather than in a court of law, to ensure a swift and confidential resolution.

Severability & Updates

  • ⚠️ Severability: If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. The invalid provision will be severed.
  • ⚠️ Modifications: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of significant changes, but it is your responsibility to review these Terms periodically for updates.
  • ⚠️ Third-Party Links: Our guides may contain links to external government portals (e.g., URSB, BRELA, EDB). We are not responsible for the content, privacy policies, or practices of any third-party websites.
